1. Introduction
Welcome to Chemical Dekho ("Platform"). These Terms and Conditions ("Terms") govern your use of our website and services at chemicaldekho.com and all associated sub-domains. By accessing, browsing, or using this Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Chemical Dekho is operated from Vadodara, Gujarat, India. Throughout these Terms, "we", "us", and "our" refer to Chemical Dekho; "you" and "your" refer to the user of this Platform, whether as a Buyer, Seller, or Visitor.
2. Platform Role & Nature of Service
2.1 Intermediary Platform: Chemical Dekho is a business-to-business (B2B) listing and discovery platform. We connect chemical buyers ("Buyers") with chemical manufacturers, importers, distributors, and traders ("Sellers"). We act solely as an intermediary. We do not manufacture, stock, sell, distribute, or deliver any chemical products.
2.2 No Transactions on Platform: Chemical Dekho does not facilitate or process payments, orders, invoices, or shipping. All commercial transactions - including pricing negotiation, payment, delivery, logistics, and after-sales support - occur directly between the Buyer and the Seller, outside of this Platform.
2.3 No Escrow or Payment Handling: We do not hold funds, provide escrow services, or act as a payment intermediary in any form. We have no visibility into or responsibility over the financial terms agreed between Buyers and Sellers.
2.4 Information Only: All product descriptions, specifications, grades, prices, COA (Certificate of Analysis), MSDS (Material Safety Data Sheet), TDS (Technical Data Sheet), and supplier details displayed on this Platform are provided for informational purposes only and are sourced directly from the Sellers.
3. Seller Verification & Its Limitations
3.1 Identity Verification: We verify each Seller's identity through the following documents submitted during onboarding: GST Certificate, Company PAN Card, and Aadhar Card of the authorized contact person. This verification confirms that the Seller is a registered business entity in India.
3.2 Scope of Verification: Our verification is limited to the Seller's legal identity and business registration. We do not verify:
- The quality, grade, purity, or composition of any product listed by the Seller
- The authenticity or accuracy of COA, MSDS, or TDS documents uploaded by the Seller
- The Seller's manufacturing capabilities, production capacity, or stock availability
- The Seller's compliance with environmental, safety, or industry-specific regulations
- The accuracy of pricing, packaging, or delivery commitments displayed on the listing
3.3 Buyer Due Diligence: Buyers are strongly advised to independently verify product quality, request physical samples, conduct site visits, and obtain independent lab testing before placing bulk orders. Chemical Dekho's "Verified Seller" badge confirms identity only - not product quality or reliability.
4. User Obligations
4.1 Regulatory Compliance: You acknowledge that chemical products listed on this Platform may be hazardous, controlled, or regulated under Indian law.
Buyers must:
- Hold all necessary licenses, permits, and certifications required to purchase and handle the chemicals they inquire about (e.g., Poison License, Explosives License, Drug License as applicable)
- Comply with all local, state, and central government regulations regarding the purchase, transport, storage, handling, and disposal of chemical materials
- Independently verify product specifications, safety data, and regulatory classifications before purchase
Sellers must:
- Provide accurate and truthful information about their products, including name, CAS number, grade, purity, and specifications
- Upload only genuine documents (COA, MSDS, TDS) issued by authorized laboratories or their own quality control department
- Maintain all required manufacturing and trading licenses and comply with applicable safety and packaging regulations
- Promptly respond to buyer inquiries and quote requests in good faith
4.2 Accurate Information: All users must provide accurate, current, and complete information during registration and while using the Platform. Providing false or misleading information may result in immediate account suspension or permanent ban.
4.3 Prohibited Activities: Users shall not use the Platform to: (a) submit fraudulent or spam quote requests; (b) scrape, copy, or harvest product data or seller contact information for competing platforms; (c) impersonate another person or business; (d) upload malware, viruses, or harmful code; (e) misuse the quote system to harass or spam sellers; or (f) list controlled substances or products prohibited under Indian law without proper authorization.
5. No Dispute Resolution by Platform
5.1 Chemical Dekho does not mediate, arbitrate, or resolve disputes between Buyers and Sellers. Since all transactions occur outside the Platform, any disputes regarding product quality, quantity, pricing, payment, delivery, or non-performance are strictly between the Buyer and the Seller.
5.2 If you experience an issue with a Seller's conduct on the Platform (e.g., spam, offensive content, fraudulent listings), you may report the Seller to us at team@chemicaldekho.com. We will review such reports and may take action including warning, suspension, or permanent removal of the Seller from the Platform, at our sole discretion.
5.3 Chemical Dekho shall not be held responsible for any financial loss, damaged goods, delayed shipments, or unresolved payments arising from transactions between Buyers and Sellers.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Chemical Dekho, its founder, officers, employees, and affiliates shall not be liable for:
- Any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of products sourced through connections made on this Platform
- Any accidents, spills, injuries, health effects, environmental damage, or property damage occurring during the transport, storage, handling, or use of chemicals
- The accuracy, authenticity, or reliability of any product information, COA, MSDS, or TDS documents listed by Sellers on this Platform
- Disputes regarding quality, quantity, pricing, payment, delivery, or any other aspect of a transaction between Buyers and Sellers
- Loss of revenue, business, data, or goodwill arising from the use of or inability to use this Platform
- Unauthorized access to or alteration of your data or transmissions
7. Hazardous Materials Warning
Users understand and acknowledge that products listed on this Platform (including but not limited to acids, solvents, oxidizers, alkalis, catalysts, pigments, and other chemical compounds) may be hazardous, corrosive, flammable, toxic, or otherwise dangerous. Chemical Dekho is not responsible for the improper handling, storage, transport, or misuse of any materials by any party. The Buyer assumes full responsibility for safety, compliance, and proper handling of all chemicals from the point of inquiry onwards. By using this Platform, you confirm that you have the necessary knowledge, training, facilities, and regulatory permissions to handle such materials safely.
8. Intellectual Property
The design, content, layout, logos, graphics, and source code of Chemical Dekho are the exclusive property of the Platform and are protected under applicable Indian intellectual property laws. Product trade names, CAS numbers, and chemical data are used for reference and discovery purposes only and remain the property of their respective owners.
9. Privacy & Data
9.1 Information collected from Buyers (name, email, phone, company) during quote requests is shared with the Sellers to whom the quote is directed. By submitting a quote request, you consent to your contact information being shared with the selected Seller(s).
9.2 Seller information collected during onboarding (business name, GST number, contact details, documents) is used for identity verification and is stored securely. Seller business names and locations are displayed publicly on product listings.
9.3 We do not sell, trade, or rent your personal information to third parties beyond the scope described above.
10. Account Suspension & Termination
Chemical Dekho reserves the right to suspend or permanently terminate any user account at our sole discretion, without prior notice, for reasons including but not limited to:
- Violation of these Terms
- Submission of fraudulent or misleading information
- Uploading fake or forged documents (GST, PAN, COA, MSDS)
- Spam or abuse of the quote request system
- Reports of unethical or fraudulent conduct from other users
- Non-responsiveness to buyer inquiries over an extended period (Sellers)
11. Indemnification
You agree to indemnify, defend, and hold harmless Chemical Dekho, its founder, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to: (a) your use of the Platform; (b) any transaction between you and another user; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.
12. Modifications to Terms
Chemical Dekho reserves the right to modify these Terms at any time. Changes will be posted on this page with the updated date. Your continued use of the Platform after any modification constitutes your acceptance of the revised Terms.
13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or the use of this Platform shall be subject to the exclusive jurisdiction of the courts in Vadodara, Gujarat, India.
